The App „YUME“ (the „App“) is owned and operated by Veronika Vencova, ID No.: 76560589, with registered office at Nad Kalvárií 3390, Havlíčkův Brod (hereinafter referred to as „YUME.coach“ „we“, „us“ or „our“). The terms „you,“ „your,“ „user“ and „users“ refer to all users of the Application.

Your use of the Application and the content and information available on the Application (the „Services“) is subject to your acceptance of and compliance with the terms and conditions set forth in these Terms of Use (the „Terms“). By expressly agreeing to these Terms, you are bound by them in their entirety and may begin using the Application. If you do not agree to these Terms, you are not authorized to use the Application. YUME.coach has the total right to edit or delete any content within the App, without notifying you.

License to use the App

1.1 Once you have paid the applicable fee (if the Service is chargeable), downloaded and installed the Application and successfully completed the registration process, you will be able to use the Application. Upon payment of any fees (if the Service is chargeable) and subject to your compliance with these Terms, you will be granted a limited, non-exclusive, revocable license to use the Application, subject to the restrictions and limitations set out in these Terms.

The purpose of  the App

2.1 The „YUME“ app is a sophisticated platform focused on personal growth and self-development, offering users a set of courses and recordings based on NLP (Neuro Linguistic Programming) methods, psychology and proven knowledge in the field of personal development. Our goal is to provide users with effective tools and techniques that address psychological aspects and emotional processes, allowing them to explore new perspectives and transform their lives.

2.2 The App contains a wide range of premium courses and audios that focus on different areas of personal development such as increasing self-confidence, stress management, motivation, goal planning and positive thinking techniques. Users have access to practical tools and exercises that allow them to actively work on their personal growth and re-evaluate their thought patterns.

2.3 Through interactive questions and reflective exercises, users are guided to deepen self-reflection and awareness of their thoughts and feelings. In this way, the „YUME“ App helps individuals identify the obstacles that prevent them from achieving their life goals and provides proven strategies to overcome them.

2.4 Our App does not include personal life-coaching or any online community, but focuses purely on individualized development through the materials and tools provided. Users learn how to use coaching techniques and psychological principles to improve their quality of life and achieve lasting change.

2.5 Overall, the „YUME“ App is designed to inspire and motivate users to achieve greater potential and build a lifestyle that matches their values and goals.

Registration 

3.1. Only registered users can use the application. Registration is done through (i) a Facebook account, (ii) a Google account, or (iii) an Apple ID account; and the name, email, and photos provided by these networks are used on the App. Changing the registered data is possible, except for the username. In case of invalid or non-existent data, we are entitled to delete the respective account. You may also delete your account, including all data provided, at any time.

Payments  

4.1. There is a fee for using the App. The User has the option of paying (i) monthly or (ii) annual fees for the use of the Application. Fees are payable through iTunes. Fees on the App automatically renew and can be cancelled at any time effective until the beginning of the next payment period.

4.2 Charges on the App are automatically renewed and can be cancelled at any time, effective until the start of the next payment period. For more information about payments, including taxes and refunds on the App, please see the iTunes and Google Play Terms and Conditions.

Disclaimer and exclusion of liability

5.1 To the fullest extent permitted by applicable law, we disclaim all representations and warranties relating to the App and its content, including in relation to any inaccuracies or omissions in the App, warranties of merchantability, quality, fitness for a particular purpose, accuracy, availability, non-infringement or implied warranties arising out of the operation or use of the App.

5.2 We do not warrant that the App will always be accessible, uninterrupted, timely, secure, error free or free from computer virus or other invasive or damaging code or that the App will not be affected by any Acts of God or other force majeure events, including inability to obtain or shortage of power or telecommunications, lack of telecommunications equipment or facilities and failure of information technology or telecommunications equipment or facilities.

5.3 While we will use reasonable efforts to include accurate and up-to-date information on the App, we make no warranties or representations as to its accuracy, timeliness or completeness.

5.4 We shall not be liable for any direct, indirect, private or public damages or injury in any way related to the use of the App.

5.5 Notwithstanding our efforts to ensure the security of our website/system, you acknowledge that all electronic data transmissions are potentially susceptible to interception by others. We cannot and do not guarantee that data transmissions under the Application or electronic mail transmitted to and from us will not be improperly monitored or read.

5.6 While we use reasonable endeavours to ensure that all software made available on the App is suitable for download, installation and use, all such software is provided without warranty of any kind. Specifically, but not limited to, we do not warrant that any such software is free of viruses, free of defects, compatible with other software or operating systems, or fit for any particular purpose. We accept no liability for loss or damage caused by the download, installation or use of any such software and your download, installation or use is subject to the general disclaimers and limitations of liability set out above.

5.7 The above exclusions and limitations of liability shall only apply to the extent permitted by law. None of your statutory rights as a consumer that cannot be excluded or limited are affected.

Exclusion of liability for health

6.1 The „YUME“ app provides users with information, tools and techniques for personal development and self-reflection through courses and audios. However, the App is not intended as a substitute for professional health care, psychological support or therapeutic services. Users should seek qualified health and mental well-being professionals if they have any health or psychological problems.

6.2 All information and advice provided on the YUME App is for information purposes only and should be seen as supplementary to professional help, not as a substitute for it. Users are fully responsible for their decisions and actions, even if they choose to apply techniques and knowledge from the App.

6.3 Users should exercise caution when participating in any specific exercises or activities recommended in the App, particularly if they have existing medical conditions. It is recommended that you consult your physician or other health professional before embarking on any personal development program.

6.4 The App „YUME“ shall not be liable for any direct or indirect consequences that may arise from the use of or reliance on the information and techniques contained in the Application. Users acknowledge that all personal development activities carry inherent risk and that it is important to be aware of one’s own health and abilities.

6.5 When using the App, you acknowledge that the App does not diagnose, provide treatment or replace professional health services. If you are experiencing serious emotional or psychological problems, we recommend that you seek advice from qualified professionals.

6.6 There have been rare reports of people with certain psychiatric problems, such as anxiety and depression, experiencing a worsening of their condition in conjunction with intensive self-reflection or meditation. People with existing mental health conditions should speak with their health care providers before using the App.

Intellectual property rights

7.1 You acknowledge and agree that all rights, title and interest in and to the „YUME“ app and its services (the „Services“) are and shall remain the exclusive property of Veronika Vencova – the Application and Services are protected by copyright, trademark, patent rights and other intellectual property laws.

7.2 You are granted only a limited, non-exclusive, personal and non-transferable right to use the App and Services in accordance with these Terms. Any other use, including reproduction, distribution, public display, transfer, modification or any other use of the contents of the Application without our prior written consent is strictly prohibited.

7.3 Nothing in these Terms shall be construed as conferring any intellectual property rights in or to the App or the Services and any part thereof, know-how, trade secrets, technology, documents or expertise that we own or use in the operation of the Application and the provision of the Services.

7.4 You may not sell, license, sublicense, rent or otherwise commercially exploit the App or Services without the prior written consent of us.

7.5 You also agree not to remove, alter or otherwise infringe any identifying information, copyrights, logos, trademarks or other intellectual property notices associated with the Application. All right, title and interest in and to our logos and trademarks remain our exclusive property.

7.6 In the event that you breach any of these Intellectual Property Terms, we reserve the right to take action to protect our rights and interests, including legal proceedings and other steps proportionate to the seriousness of the breach.

Personal Data

8.1 Use of the App is only permitted after you have given your prior consent to the processing of your personal data and to the Privacy Policy.

8.2 For the purposes of registering for and using the App, we process your personal data in accordance with the relevant data protection regulations, in particular the Data Protection Act and the General Data Protection Regulation (GDPR), the General Data Protection Principles and the individual consent to the processing of personal data that you have given us.

Withdrawal from the contract

9.1 You acknowledge that by accepting these Terms and Conditions, you are entering into a contract for the supply of digital content that is not delivered on a tangible medium (the „Contract“). You agree that the Contract will be performed, i.e. the Application will be used, before the expiry of the statutory withdrawal period, and that this gives you the right to withdraw from the Contract without giving any reason within 14 days.

9.2 The right to withdraw from the Contract for reasons provided for by law is not affected. If you decide to withdraw from the Contract, please inform us of your decision by sending us a clear statement (e.g. by email).

9.3 Upon receipt of your notice of withdrawal, we will promptly acknowledge receipt of your notice.

9.4 In the event of cancellation, all payments received from you will be refunded to you without undue delay and no later than 14 days after receipt of your notice of cancellation. We will refund you in the same way you made the payment unless you have expressly agreed to a different method of refund.

Change of terms

10.1 These Terms may be unilaterally modified or amended by YUME.coach at any time. All changes and modifications to these Terms will take effect upon their posting on the Application (i.e. the date of the last update).

10.2 We reserve the right to change the Terms based on enhancements or improvements to the Services, changes in legislation or needs arising from the practical performance of the Application.

10.3 Users will be notified of changes to the Terms via a notice on the App or by email. By continuing to use the App after the amended Terms have been posted, you agree to be bound by those changes.

10.4 It is your responsibility to monitor the Terms regularly and be aware of any changes to them. If you do not agree to the new Terms, we recommend that you stop using the Application.

Applicable law and jurisdiction

11.1 These Terms and Conditions and all relationships arising hereunder shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of laws provisions.

11.2 All disputes arising out of or in connection with these Terms and Conditions shall be resolved exclusively by the competent courts of the Czech Republic. This includes disputes relating to the validity, interpretation and performance of these Terms.

11.3 Users agree to first attempt to resolve any disputes amicably before filing a lawsuit. If an agreement cannot be reached within 30 days of written notice of the dispute, the parties may proceed to court.

11.4 Users also agree to comply with all laws and regulations of the Czech Republic that may apply to their use of the Application and Services.
